Terms of Service

By accessing or using Aixr Dataset Creator at dmc.meforgers.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree with any part of these Terms, you may not use the Service. These Terms may be updated from time to time. If you do not agree to any changes, you must cease using the Service.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to register and use the Service. By using the Service, you represent that you meet these age requirements and have the legal capacity to enter into a binding contract. You further represent and warrant that you have read, understood, and agree to these Terms and our Privacy Policy.

You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your computer or device. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for all activities that occur under your account. You agree to notify Meforgers immediately of any unauthorized use of your account or any other breach of security. Meforgers cannot and will not be liable for any loss or damage arising from your failure to comply with this section, including if you share your password or allow anyone else to use your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the platform software.
• Modify, adapt, translate, or create derivative works from the platform software.
• Use the Service to create or distribute malicious or discriminatory content.
• Interfere with or disrupt the integrity or performance of the Service or data contained therein.
• Use any automated system or software (e.g., bots, spiders, scrapers) to access or collect data from the Service, unless expressly permitted.
• Harass, threaten, or otherwise annoy other users.
• Post content that infringes on the intellectual property rights or privacy rights of others.

You retain ownership of content (“User Content”) you upload, create, or submit through the Service. However, by submitting any User Content, you grant Meforgers a worldwide, royalty-free, irrevocable, perpetual, sublicensable, and transferable license to use, reproduce, analyze, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content for research, development, platform improvement, security, and AI/data model training purposes (as described in the Privacy Policy).

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to upload such content and to grant Meforgers the license granted herein, and that your User Content does not infringe the rights of any third party (including, but not limited to, intellectual property rights, privacy rights, or publicity rights). You are solely responsible for the confidentiality, integrity, and security of your User Content. While Meforgers implements reasonable security measures, the Service is designed to allow users full control over their data, including the ability to freely download their data. Meforgers cannot guarantee absolute security or protection against data loss caused by user actions or external factors.

All intellectual property rights in the Service (including, but not limited to, software, design, branding, documentation, algorithms, and methodologies) are owned by or licensed to Meforgers. These Terms do not grant you any right or license in or to the Service, or any part thereof, except for the limited right to access and use the Service under these Terms. All trademarks, service marks, and logos displayed on or through the Service are the property of Meforgers or their respective third-party owners. You may not use these trademarks without the prior written permission of Meforgers or the respective owner.

Meforgers reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if:

• You violate these Terms.
• Your use of the Service poses a security risk or may cause legal liability for Meforgers or other users.
• Such action is required by law or a government request.

Upon termination, your right to use the Service ceases immediately. However, internal usage rights granted under Section 5 (User Content & License) may continue as necessary for Meforgers's ongoing research and development purposes, and certain provisions of these Terms, including but not limited to Sections 5, 6, 8, 9, 10, 11, and 16, shall survive termination. In the event of account termination, your right to retrieve your data may cease.

The Aixr Dataset Creator platform is designed to provide users with maximum control over their uploaded data. Users are given the explicit ability to freely download, manage, and back up their User Content at any time. Due to this fundamental design principle, and the inherent risks associated with data storage and transmission, Meforgers does not undertake any responsibility or liability for data loss. This includes, but is not limited to, data loss resulting from:

• User actions or omissions (e.g., accidental deletion, mishandling of data, failure to back up data).
• System failures, technical issues, software bugs, or infrastructure problems within Meforgers's own systems or those of its third-party service providers.
• Cyberattacks, unauthorized access, data breaches, or other security incidents.
• Natural disasters, acts of God, or any other events beyond Meforgers's reasonable control.

By using the Service, you explicitly acknowledge and agree that you are solely responsible for creating and maintaining backup copies of your User Content, and that Meforgers will not be liable for any damages or losses arising from the loss, corruption, or unavailability of your data, regardless of the cause.

THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MEFORGERS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MEFORGERS MAKES NO WARRANTIES REGARDING THE RELIABILITY, ACCURACY, COMPLETENESS, SECURITY, OR AVAILABILITY OF THE SERVICE. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK. MEFORGERS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. MEFORGERS MAKES NO REPRESENTATION OR WARRANTY AS TO THE ACCURACY OR COMPLETENESS OF ANY RESULTS OR INFORMATION OBTAINED THROUGH THE SERVICE. AS FURTHER DETAILED IN SECTION 8 (DATA RESPONSIBILITY & USER CONTROL), YOU ACKNOWLEDGE AND AGREE THAT MEFORGERS SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DATA LOSS, CORRUPTION, OR UNAVAILABILITY OF YOUR USER CONTENT, AS THE SYSTEM IS PRIMARILY UNDER USER CONTROL FOR DATA MANAGEMENT AND BACKUP.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MEFORGERS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA (INCLUDING USER CONTENT), USE, GOODWILL, OR OTHER INTANGIBLE LOSSES (EVEN IF MEFORGERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE, ANY CONTENT OBTAINED FROM THE SERVICE, OR RELIANCE ON ANY INFORMATION OBTAINED FROM THE SERVICE. This includes, but is not limited to, any data loss or corruption, regardless of the cause, as the responsibility for data integrity and backup lies predominantly and ultimately with the user. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN NO EVENT SHALL MEFORGERS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

You agree to defend, indemnify, and hold harmless Meforgers, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your User Content (including but not limited to any claim that your User Content infringes the intellectual property or other rights of any third party, or any data loss or corruption stemming from your actions, omissions, or failure to maintain backups). This indemnification obligation will survive the termination of your account and these Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or the Service shall be exclusively resolved by the courts of İstanbul, Turkey. The parties hereby consent to the exclusive jurisdiction of the courts located in Turkey, for the resolution of any such disputes.

We may revise these Terms at any time by posting an updated version on the Service. The updated Terms will be effective as of the date of posting. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms. While we will make reasonable efforts to notify you of material changes (e.g., via a notice on the Service or by email), it is your responsibility to regularly review these Terms for updates.

Your use of the Service is also subject to the provisions of our Privacy Policy. Our Privacy Policy describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the data practices described therein.

The Service may contain links to third-party websites or services that are not owned or controlled by Meforgers. Meforgers has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Meforgers shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

Meforgers's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Meforgers regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.
